Was The Supreme Court Leaker A Supreme Court Justice?

It’s the biggest media mystery since Deep Throat was meeting Bob Woodward in a dimly lit parking garage.

Who is the Supreme Court leaker? Are they protecting one of their own?

This, however, does tremendous damage to the high court’s credibility, where both sides agree that the act of leaking a draft opinion is appalling.

Everyone’s got a theory, and nobody knows who handed Politico’s Josh Gerstein the draft opinion overturning Roe v. Wade.

Our friends from WLT have a theory of who the leaker is:

It’s no secret that we live in peculiar, some might say, revolutionary times. In the last 2 years alone we have lived through the plots of two science fiction films—Contagion and Close Encounters of the Third Kind.

Changes in technology now threaten the state’s monopoly on minting money, and an election was stolen right before our very eyes…

To top it all off, the Supreme Court recently reversed Roe v Wade—likely their most significant ruling in a generation.

Amid all this pandemonium, and beset by a world changing at an unprecedented rate, people seem to be feeling the heat…

It has been roughly two months since the world learned of a leaker, either working on behalf of the Supreme Court or among the very ranks of the Supreme Court Justices themselves, who disseminated the Roe v Wade opinion.

Politicians and members of the court alike vowed a sweeping investigation into the leak and swift retribution for the leaker, but two months later we still don’t have any answers…

Previously, the high court began taking unprecedented measures—like requesting the phone records of clerks, but alas, they seem to be no closer to finding out the identity of the leaker, or are they?

Could SCOTUS be protecting one of their own? Is the leaker a Supreme Court Justice? A certain Obama appointee perhaps?

Pundits, journalists, and concerned citizens alike all wonder:

The Daily Wire writes:

The Daily Wire has repeatedly pressed the court as to what stage its investigation is at, more than 50 days after the leak, and whether the leaker has been identified.

A spokeswoman for the Supreme Court has not addressed these requests for comment.

Breitbart reports that President Trump is calling for an investigation into the leak:

“And I especially want to commend the justices for standing strong in the face of outrageous threats and even violence. You’ve been seeing what’s been going on. There’s never been a time like this,” Trump said, adding:

The left wing campaign of terror directed at the Supreme Court in recent months is unlike anything in the history of our country.

The attempted assassination of Justice Kavanaugh, the illegal intimidation of Justice’s homes and the radical left violent terrorist attacks on pro life centers were a frontal assault on our republic.”

One interesting twist, as Chief Justice John Roberts orders the marshals to investigate the leak he calls a breach of trust, is that the move itself may not be illegal.

Draft opinions aren’t classified, and there’s no law against sharing them with the press – though this would previously have been unthinkable. Unless theft or computer hacking was involved, the leaker, if caught, should be fired, but is unlikely to be prosecuted.

While the Democrats, led by Joe Biden and Kamala Harris, are casting the likely ruling as a terrible blow for women and an energizing issue for the midterms, they probably can’t do much about it.
