‘Lawsuit Against DC Mayor Over Black Lives Matter Street Banner Heads To Court (Video)’ – First Amendment/Establishment Clause In Play

On Tuesday, the Conservative Firing Line was the first to report that a lawsuit was to be filed against Washington, D.C. Mayor Muriel Bowser by three Christian activists over a large “Black Lives Matter” street banner, arguing the banner violates the Establishment Clause of the First Amendment to the Constitution.

Early Friday morning, attorney Chris Sevier told the Conservative Firing Line in an exclusive interview that the case is headed to the U.S. District Court for the District of Columbia.

Sevier tells us the case, titled, Penkoski v. Bowser 2020-cv-01519 (D.C. June 2020), has been assigned to the Honorable Judge McFadden, a Trump appointee who not only worked for the Department of Justice but served as a police officer.

This should get interesting really fast as the parties intend to file motions for an emergency restraining order by the beginning of next week,” Sevier said.

The plaintiffs include Pastor Rich Penkoski of Warriors For Christ, Chris Sevier Esq. of De Facto Attorneys General and Tex Christopher of Special Forces Of Liberty.

The Washington Times noted:

The lawsuit, filed in federal court on Wednesday, complained Ms. Bowser’s move, as well as her decision to rename a nearby street “Black Lives Matter Plaza,” came at the taxpayers’ expense but showed a preference for one faith — or belief — over others.

The main argument in the 51-page complaint filed at the U.S. District Court for the District of Columbia is that Ms. Bowser is violating the Establishment Clause of the U.S. Constitution by supporting one orthodoxy over others.

“The Black Lives Matter banner conveys that black people are the favored race of the city of DC, which is of course a racist contention floated by a racist Democrat who persistently refuses to think logically,” the lawsuit said.

The plaintiffs are asking the court to order Bowser to alternate other banners down the street so she is not showing favoritism to Black Lives Matter.  They also want her to rename the Black Lives Matter Plaza to something more secular at the city’s expense.

The video argues that if the court does not take measures to correct Bowser’s actions, the “country will continue to spiral into turmoil and toxic division.”

According to the Times, Bowser’s office, “…did not immediately respond to a request for comment about the lawsuit.”
