GSA Administrator Approves Transitional Assistance for Self-Appointed “President-Elect” Biden after Receiving Death Threats

In an unexpected turn of events, the GSA (General Services Administration) Administrator Emily Murphy — who initially had denied Joe Biden’s request for government-funded transitional assistance as the self-appointed President-elect — has capitulated and approved it. This will entitle Biden to million for travel expenses, salaries for his transitional team, and office space.

Meanwhile, the 2020 presidential election is highly contested. A winner has not been officially called, the election has not yet been certified, and President Trump’s legal team is still in pursuit of legal remedies for what many believe was a stolen election wrought with tremendous fraud.

Although Murphy denies her decision was prompted by pressure or fear, she has been under relentless attack. In her letter to Biden today, she seems to express great conflict:

I have dedicated much of my adult life to public service, and I have always strived to do what is right. Please know that I came to my decision independent, based on the law and available facts. I was never directly or indirectly pressured by an Executive Branch official — including those who work at the White House or GSA — with regard to the substance or timing of my decision. To be clear, I did not receive any direction to delay my determination. I did, however, receive threats online, by phone, and by mail directed at my safety, my family, my staff, and even my pets in an effort to coerce me into making this determination prematurely. Even in the face of thousands of threats, I always remained committed to upholding the law.

Contrary to media reports and insinuations, my decision was not made out of fear or favoritism. Instead, I strongly believe that the statute requires that the GSA Administrator ascertain, not impose, the apparent president-elect. Unfortunately, the statute provides no procedures or standards for this process, so I looked to precedent from prior elections involving legal challenges and incomplete counts. GSA does not dictate the outcome of legal disputes and recounts, nor does it determine whether such proceedings are reasonable or justified. These are issues that the constitution, federal laws, and state laws leave to the election certification process and decisions by courts of competent jurisdiction. I do not think that an agency charged with improving federal procurement and property management should place itself above the constitutionally-based election process. I strongly urge Congress to consider amendments to the Act.

President Trump, condemning the harassment and abuse, weighed in on Twitter to thank her for her dedication and loyalty to the country, stressing, “. . . I believe we will prevail! Nevertheless, in the best interest of our Country, I am recommending that Emily and her team do what needs to be done with regard to initial protocols, and have told my team to do the same.”

Earlier this month, in a November 13 letter, Ranking Member of the Subcommittee on Government Operations Jody Hice encouraged Murphy to tune out the external noise from the media and to follow the Constitution. “There are enough state contests in question, such that there is not yet an apparent President or Vice-President-Elect,” she states.

“According to Congressional intent and past precedent set by President Clinton,” Hice later continues, “as of today, there is no apparent President-Elect.”

A GSA spokesman recently stated that ‘the GSA Administrator ascertains the apparent successful candidate once a winner is clear based on the process laid out in the Constitution.’7

I strongly encourage you to do just that: follow the Constitution and past precedent, not the media, when making your determination of the President-Elect. This democracy relies on a rule of law and the law must be followed.
